SOFTWARE LICENSE FOR CHROMACOLOUR’S PALETTE(S) - FLASH VERSION

Series 100, 600 and 1200

This is an agreement between you, the end user, and ChromaColour (hereinafter referred to as the "Vendor"). By purchasing this software, you are agreeing to become bound by the terms of this agreement.

IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU CANNOT PURCHASE THIS SOFTWARE

LICENSE. Vendor grants to you a non-exclusive right to use the software palette(s) - (hereinafter referred to as the "Software"). This software is protected by copyright laws and may only be used in accordance with the license terms. Permission to purchase and use the software is conditional upon you agreeing to the license terms.  The purchase, installation or use of the software by you will be deemed to be acceptance of the license terms.  Acceptance will bind you to the license terms in a legally enforceable contract with ChromaColour.

INTELLECTUAL PROPERTY, You agree not to remove, obscure, or alter ChromaColour’s copyright notice, trademarks, or other proprietary rights notices affixed to or contained within or accessed in conjunction with or through the Software.

OWNERSHIP OF SOFTWARE. Vendor retains the copyright, title and ownership of the Software and the written materials.

This Agreement allows you to install and use the Software on a single computer in concurrent use with a single licensed version of Macromedia Flash.

You cannot copy the software, however, you may make one backup copy, provided your backup copy is not installed or used concurrently on different computers. You must reproduce on any such copy all copyright notices and any other proprietary legends on the original copy of the Software. Network use of the software is not allowed. ChromaColour is not obligated to provide maintenance, support, or updates to you for the Software. 

THIS SOFTWARE AND ACCOMPANYING DOCUMENTATION (INCLUDING INSTRUCTIONS FOR USE) ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. FURTHER, VENDOR DOES NOT WARRANT, GUARANTEE, OR MAKE ANY REPRESENTATIONS REGARDING THE USE, OR THE RESULTS OF USE, OF THE SOFTWARE OR DOCUMENTATION IN TERMS OF CORRECTNESS, ACCURACY, RELIABILITY, CURRENTNESS, OR OTHERWISE. THE ENTIRE RISK AS TO THE RESULTS AND PERFORMANCE OF THE SOFTWARE IS ASSUMED BY YOU. IF THE SOFTWARE OR WRITTEN MATERIALS ARE DEFECTIVE, YOU, AND NOT VENDOR OR ITS  DISTRIBUTORS, AGENTS, OR EMPLOYEES, ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.

NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY VENDOR, ITS DISTRIBUTORS, AGENTS OR EMPLOYEES SHALL CREATE A WARRANTY AND YOU MAY NOT RELY ON ANY SUCH INFORMATION OR ADVICE.

This License and any breaches of this agreement shall be governed and construed in accordance with the laws of Alberta, Canada and shall benefit Vendor, its successors and assigns.
